Choosing The Right
One
Immigration attorneys are specialists in immigration law who can
help you to gain the right to live and work in another country, or defend you if you are accused of being an
illegal immigrant.
The first step in choosing immigration attorneys is to think
about the jurisdiction. For the purposes of this article we will assume that you want to live in the USA. If you
are already in the USA, then you can easily go to a US law firm. But if you are living in another country right
now, you need to decide whether to hire an American lawyer or try to find somebody in your own country who
understands American immigration law. The second option may be cheaper but unless you can find somebody with
special knowledge, US lawyers usually know the law of their own country best.
It is a good idea to meet with two or three different attorneys
so that you have a choice. You will want somebody who understands your situation and knows what you want and how to
get it.
Of course, money is important too. You will need to know the
fees that they charge. Also ask for an estimate of any expenses. This kind of thing can be difficult to assess
ahead of time because the lawyer cannot be sure how much work may be involved in a case. However, if you give them
plenty of information about your situation they should be able to give you an estimate that you can use to compare
fees across different attorneys.
This will also give you an idea of how much money you may need
to see the case through to a final outcome. There is no point in hiring a lawyer at all if you have to give up half
way through the process because you cannot afford to pay any more fees.
People go to immigration lawyers for different reasons. Some
clients may be living in a country already, unofficially, having overstayed their visa. Others are citizens who
want to arrange for their overseas fiancee to come live with them. These are very different situations and some
lawyers may be more skilled at handling one type of case or the other.
When you have made appointments with one or more immigration
attorneys, you will need to collect together all of your relevant papers. This includes your birth certificate,
passport, marriage certificate, and any other papers that relate to your claim such as offers of
employment.
You will need to show these papers to the attorney so that he or
she can assess the strength of your case, but never leave them at the office. Have them make a photocopy so that
you can bring the originals home. You may need them for another purpose and they could easily be
lost.
If you have done nothing criminal, always tell your attorney the
truth about your immigration situation. They are on your side and there is no need for you to hide information from
them.
If you have committed a criminal offense such as entering the
country illegally, you can decide whether or not to tell your attorney. The confidentiality rules are different
when it comes to criminal matters and it may affect the way that they can handle the case. Never expect your
attorney to tell lies for you, because they are not allowed to do that.
On the other hand it is usually better for them to have the true
facts. Immigration attorneys will have the best chance of acting for you successfully if they know exactly
what your situation is.
