Can They Do For You?
A personal injury attorney is the person to call if you
have suffered any kind of harm that was not your fault, and you want to claim compensation either in court or out
of court.
Examples of personal injury cases include:
- if you are hurt in an auto accident
- if you have been injured on somebody's property, for example by falling down slippery stairs (premises
liability)
- if you have suffered from malpractice or negligence during medical
treatment
- if you have been intentionally hurt by somebody, e.g. if you have suffered physical assault
The injury that you have suffered does not have to be physical. You may have suffered from libel or slander, where
somebody has written or said something untruthful about you, and your reputation has suffered as a result of that.
You can also be compensated for legal malpractice if you think that a legal professional has not acted well for
you.
Personal injury lawyers are also involved in cases of wrongful death,
where somebody important in your life has died as a direct result of somebody else's actions.
Your attorney will study the details of your case and advise you on the steps that can be taken. If you are
receiving medical treatment for the injury that you suffered, the attorney's first priority will be to win an
agreement to have the medical costs covered. After that they will negotiate a settlement for
damages.
Out of court settlements are reached in most cases, when the two sides agree on a compensation figure. However, if
you are thinking of hiring a personal injury attorney then you need to think about whether you would be prepared to
take the matter to court if necessary.
Many personal injury lawyers are qualified specialists in this area of law. This means that they have been
certified by the state bar or board of legal specialization. Accident and injury law is not the most common form of
law practiced, but it is an area where many attorneys take the time to complete the requirements so that they can
advertise their services as a specialist in personal injury law.
This means that it is often simple to find a personal injury attorney because you will see ads for them. Of course,
you may prefer to ask around for recommendations. Perhaps you know somebody who has won compensation for something
and was happy with the work that their attorney did for them. If not, you could ask a lawyer that you have used for
other work to recommend somebody, or call a firm of lawyers that has a good reputation in your area. They will
probably have a personal injury law specialist among their staff.
Many lawyers specialize further and only take certain types of personal injury cases. For example a personal injury
attorney may specialize in medical malpractice cases, or auto
accidents.
